I am about to purchase a used dirt bike and was wondering what I need to look for in regards to the title.
Is it an issue if the current owner hasn't taken the time to get the title in his name? As long as the title is signed by the previous owner.
The bike isn't tagged but if in the future I decide to go the South Dakota route will I have issues?
You won't have any issues with the title being signed by the previous owner...you'll just have to make a BOS with their name and copy the signature on it as best you can. The people at the DMV don't know who you bought it from. :respect-048:
From what I remember from the last SD tagging I did, you have to fill out an affadavit stating that the vehicle has never been titled before and that your state doesn't title off-road vehicles (or similar wording). If it has a title currently, might cause issues. Or maybe SD doesn't check/care and just wants the money...dunno.
So to get a title in my name I have to take it and the bill of sale to the dmv? In SC you could just mail it in!
Yep, title and bill of sale.
Also...the sale price shown on the B.O.S. is what they use to assess the sales tax, so remember that you only paid @ $1200 (or less) when you make out the bill of sale. The registration fee is based on the assessed value of the bike.

Are you saying that you bought a previously titled bike (originally an offroad only bike)? Is it an Alabama street legal title? Is the title not in the name of the person that you bought it from?
If that's the case, don't go through South Dakota. Just get the title signed over to you. If it's from another state a VIN inspection will be required but it's no big deal.
Thank you all for the insight. Here is the story.
The bike currently has a Mississippi title that has been signed over 3 times. The 3rd time was only signed, not dated, by the owner before the guy I bought it from.
Based on a talk with KP I think I will end up just going the South Dakota route as if I don't have a title. I probably won't do anything until next year if things calm down a little.

Maybe obvious to some, but let me offer some hints to keep from wasting time and getting very mad. Make sure all documents match exactly. That means use middle initials when needed and don't use them if not. Also, don't use a pre-filled out BOS with the persons name as you know it then cross out that name and fill in their legal name (even initialed the change). Guess how I know this is an issue.
